After a quiet 10 months, what is happening to the Vallow Daybell case?

Last week District Judge Steven Boyce issued an order detailing Lori Vallow Daybell is now competent to proceed forward in her trial, and therefore lifted the pause that was set on her trial 10 months ago.

On April 14, Vallow-Daybell arrived back in Eastern Idaho and was booked in the Madison County Jail after being released from an Idaho Department of Health and Welfare Facility.

During the first hearing since her release on April 19, prosecutors argued to bring in a jury from Ada County rather than moving the trial across the state as previously discussed. After the hearing, the trial is set to begin in January at the Ada County Courthouse and is expected to last up to 10 weeks.

During her arraignment on April 19, Daybell remained silent. Her attorney asked the judge to enter a not guilty plea on her charges including:

  • First-degree murder in the death of Tylee Ryan
  • First-degree murder in the death of Joshua “JJ” Vallow
  • First-degree murder in the death of Tammy Daybell
  • Conspiracy to commit first-degree murder and grand theft by deception in the death of Tylee Ryan
  • Conspiracy to commit first-degree murder and grand theft by deception in the death of Joshua “JJ” Vallow
  • Conspiracy to commit first-degree murder in the death of Tammy Daybell
  • Grand theft related to Social Security survivor benefits over $1,000 allocated for the care of minors Tylee Ryan and Joshua “JJ” Vallow that was appropriated after the children were missing and ultimately found deceased.

Another interesting highlight of this trial is her attorney Jim Archibald claiming despite Vallow-Daybell currently being scheduled for a trial with her husband Chad Daybell in January 2023, his client did not intend to waive her right to a speedy trial, meaning her court proceedings would need to begin by the fall.

Lastly as of April 21 prosecutors have 60 days remaining to decide to file for the death penalty against the Daybells.
